Terms and Conditions of Sale

NOTES
This document establishes the terms and conditions of sale between Sport Service, hereinafter referred to as SELLER, and the customer, purchaser of the goods, hereinafter referred to as BUYER.

AUTHENTICITY
The Seller guarantees the authenticity of the goods supplied and the compliance with the quality requirements of the product.

PRICES
Prices are exclusive of VAT and will be established by the Seller. Any discounts can be agreed exclusively with the Seller.

ORDER
The Buyer's order will be subject to verification and approval by the Seller.
Orders with a taxable value of less than €500.00 (excluding VAT) will not be accepted.
The quantities at the time of order may not coincide with the quantities available in stock at the time of processing/executing the order; in this case, the Seller will confirm the exact quantities that can be supplied.

DELIVERY
The delivery terms stated in the order by the Seller or those requested by the Buyer will be purely indicative, and will not bind the Seller who will therefore not be held accountable for any delays in delivery. Any delays in delivery will never give the Buyer the right to cancel what has been ordered, nor to claim any reimbursement from the Seller for any direct or indirect damages.
The delivery of goods for national shipments will be carried out, unless otherwise agreed between the parties, through courier or agents of the Seller. National shipping costs, for orders with a taxable value of more than €1,000.00 (excluding VAT), will be borne by the Seller; according to the Incoterms 2000® term DDP (Delivered Duty Paid), rights and risks are passed to the Buyer when the goods are delivered to the address previously established by the Buyer.
For orders with a taxable value of less than €1,000.00 (excluding VAT), the goods will be delivered EXW (Ex Works) in Veggiano, therefore the Buyer will be charged the transport costs.
International shipments will be defined according to the Incoterms 2000® term EXW (Ex Works Veggiano), according to which rights and risks will be borne by the Buyer, including all transport and insurance costs from the Seller's warehouse. The Buyer shall arrange for the collection of the goods by means of a trusted courier or, in the case of a representative, by prior notice to the Seller.
In the case of goods collected directly by the Buyer, the delivery is meant Ex Works Veggiano, therefore any problem during the transport is to be borne by Buyer.
At the time of receipt of the goods, the Buyer will be obliged to verify the conditions and the quantity of the goods received.

CLAIMS
In the case of goods shipped through the Seller's courier, the Buyer shall verify that there has been no tampering with the packaging (replaced adhesive tape, overlapping transparent adhesive tape, tampered metal clips, missing parcels, etc.) and, if there has been, shall file a claim directly with the courier.
If the packaging is intact, the claim must be filed to the Seller. If the Seller's control reveals that the items have been shipped, the Buyer shall provide proof of the lack of the goods.
No claims will be accepted after 8 (eight) days from the receipt of the goods.

UNDELIVERED GOODS
For deliveries through courier appointed by the Seller, in the event that there are undelivered goods due to wrong instructions from the Buyer, the Buyer will be charged all the costs of managing the stock.

RETURNS
Any faulty returns will be accepted, with the authorization of the Seller, within 1 (one) year from the date of delivery, after which the Seller will be exempt from accepting the return of the item.
In case of fault, the Buyer must send an e-mail as soon as possible to returns@sportservicesrl.com with a photo of the product, a photo of the faulty detail and, in the case of footwear, a photo of the sole to determine wear; in addition, for each item the Buyer must report its code, its size and a description of the type of fault.
Subsequently, the Seller will reply with an e-mail reporting the outcome of the acceptance to the return and further information on how to perform it.
Shipping costs for returned goods shall be borne by the Buyer, unless agreed otherwise.
Returns will not be accepted without authorization, when visibly used or dirty, or when the required documentation is missing or incomplete.

PAYMENT
Payments for supplies will be made within the manners, the time limits and the methods agreed upon with the Buyer.
In the event of payments being made after the agreed upon due date, the Buyer will be charged the default interest calculated on the sums paid overdue multiplied by the days past the deadline, applying a 4% (four) rate.

COURT OF JURISDICTION
For any disputes, the only recognized court of jurisdiction is the one in Padua (Italy).
